Terms of Service

By creating an Aqarna account or otherwise using the Service, you confirm that you have read and agreed to these terms and our Privacy Policy. If you do not agree, please do not use the Service. You must be at least 18 years old and legally capable of entering contracts.

Aqarna is an online platform that lets owners and agents post property listings for sale or rent in Sudan, and lets buyers and renters browse them and contact posters directly. Aqarna is not party to any transaction, charges no commission on transactions, and does not provide brokerage or legal services.

You are responsible for keeping your login details and password confidential, and for all activity on your account. The information you provide (name, phone, email) must be accurate and current. We may suspend or close any account that uses fake information or impersonates someone else.

You alone are responsible for the accuracy of the listings you publish. You agree that:

• You own the property or are an authorised agent and have the right to offer it for sale or rent.
• Details (location, area, price, photos) are correct and up to date.
• You will not post the same property multiple times or duplicate listings to boost visibility.
• Listings will not contain content that breaks Sudanese law, incites hatred, includes inappropriate imagery, or violates the rights of others.
• You understand that Aqarna may review listings before or after publication and may reject or remove any listing that does not comply with these terms, without prior notice.

When using the platform, you must not:

• Post misleading information or fake listings.
• Automatically scrape data or access the Service via bots or automated tools without written permission.
• Send unsolicited messages to users, attempt fraud, or contact users for purposes unrelated to the listed property.
• Move transactions off-platform before verifying the poster, or pay large amounts without inspecting the property.
• Attempt to breach Aqarna's systems, probe for vulnerabilities, or access other users' accounts.
• Bypass verification controls or create multiple accounts after a previous account has been suspended.

Posting standard listings is free. You can upgrade your listing to "Featured" or "Boosted" for fees stated on the packages page. Fees are non-refundable unless we remove the listing due to our error. Prices include any applicable taxes unless stated otherwise.

The Service is provided "as is". Aqarna does not warrant the accuracy of information in listings, does not provide utilities or title to any property, and is not responsible for disputes between posters and users. You must verify the property and its documents before signing any agreement or paying any amount. In all cases, Aqarna's maximum liability is limited to the amount you have actually paid the platform in the 12 months preceding the claim.

The name "Aqarna", its logo, site design, and code are the exclusive property of Aqarna Limited. You retain ownership of the content you publish (photos, descriptions), but you grant us a worldwide, non-exclusive licence to use and display it on the platform, our apps, and our marketing channels for the purpose of promoting your listing.

We may suspend or close any account that breaches these terms. You may close your account at any time from the "My account" screen. On closure, we delete your data per the Privacy Policy, except where we are legally required to retain it.

We may amend these terms to reflect product changes and legal requirements. We will publish the new version on this page and notify you of material changes at least 14 days before they take effect. Continued use of the Service after an update means you accept the amended terms.

These terms are governed by the laws of Sudan, and any disputes will be settled before the competent courts in Khartoum, unless agreed otherwise in writing.
